- Definitions (Section 2):
- The order adopts definitions established in Executive Order 14168, titled Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government (Sec. 2).
- “Sex” means an individual’s immutable biological classification as either male or female. It does not mean “gender identity.”
- “Women” or “woman” and “girls” or “girl” means adult and juvenile human females, respectively.
- “Men” or “man” and “boys” or “boy” means adult and juvenile human males, respectively.
- “Female” means a person belonging, at conception, to the sex that produces the large reproductive cell.
- “Male” means a person belonging, at conception, to the sex that produces the small reproductive cell.
- Preserving Women’s Sports in Education (Section 3):
- The Secretary of Education must:
- Follow the court ruling that vacated the regulation titled "Nondiscrimination on the Basis of Sex in Education Programs or Activities Receiving Federal Financial Assistance" (April 29, 2024) (Sec. 3(a)(i)).
- Take actions to protect female-only athletic opportunities and locker rooms in accordance with Title IX, ensuring that women’s sports are reserved for women (Sec. 3(a)(ii)).
- Prioritize Title IX enforcement against institutions that require female athletes to compete with or against males or share private spaces with males in sports settings (Sec. 3(a)(iii)).
- Federal agencies must review and, where appropriate, revoke funding for educational programs that fail to comply with this policy (Sec. 3(b)).
- The Department of Justice is tasked with supporting federal agencies to ensure swift enforcement of this policy (Sec. 3(c)).
- Preserving Fairness and Safety in Women’s Sports (Section 4):
- The Assistant to the President for Domestic Policy must:
- Convene representatives from major athletic organizations and female athletes to promote fair and safe sports policies consistent with Title IX (Sec. 4(a)(i)).
- Engage with State Attorneys General to identify best practices for enforcing equal opportunities for women in sports (Sec. 4(a)(ii)).
- The Secretary of State must:
- Withdraw support from sports programs that classify female sports categories based on identity rather than biological sex (Sec. 4(b)(i)).
- Advocate for international standards that establish sex-based female sports categories and may convene international athletic organizations to discuss these policies (Sec. 4(b)(ii)).
- The Secretary of State and the Secretary of Homeland Security must:
- Review and adjust policies on admitting males seeking to compete in women’s sports in the United States, to prevent such entry where legally possible (Sec. 4(c)).
- The Secretary of State must also work with the International Olympic Committee to promote eligibility standards that ensure participation in women’s sports is based on sex, not gender identity or testosterone reduction (Sec. 4(d)).
